Acceptance of Terms

By accessing or using the Bay Hill Estates website (bayhillestatespbg.org) and Resident Portal ("the Site"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Site.

These terms apply to all visitors, residents, and others who access the Site. Bay Hill Estates Property Owners Association ("Bay Hill Estates," "we," "us," or "our") reserves the right to update these terms at any time. Continued use of the Site following any changes constitutes acceptance of those changes.

Eligibility & Resident Portal Access

The public-facing portions of the Site are available to all visitors. The Resident Portal is restricted to verified property owners and authorized residents of Bay Hill Estates.

  • You must provide accurate and complete information when registering for a portal account.
  • Account access requires email verification and approval by the Bay Hill Estates administration.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You agree to notify us immediately of any unauthorized access to your account at bheinfo@bayhillestatespbg.org.
  • Sharing your account credentials with others is prohibited.

Acceptable Use

When using the Site and Resident Portal, you agree not to:

  • Submit false, misleading, or fraudulent information
  • Harass, threaten, or intimidate other residents or community staff
  • Post content that is defamatory, obscene, discriminatory, or otherwise inappropriate
  • Use the classifieds, announcements, or any community feature for commercial solicitation unrelated to the Bay Hill Estates community
  • Attempt to gain unauthorized access to other accounts or the backend systems
  • Scrape, harvest, or systematically collect data from the Site
  • Upload files that contain viruses, malware, or malicious code
  • Violate any applicable local, state, or federal law

We reserve the right to suspend or terminate portal access for any user who violates these terms.

Community Standards for Portal Content

The Resident Portal includes features such as classifieds, event registration, ARC submissions, and community feedback. When using these features:

  • Classifieds: Listings must be for items or services relevant to residents. No commercial spam, adult content, or illegal items.
  • ARC Requests: Submissions must be accurate and relate to genuine proposed improvements to your property.
  • Speak Up / Feedback: Concerns and compliments should be submitted in good faith. Abusive or threatening language will result in account review.
  • Community Directory: Directory information is for resident-to-resident communication only and may not be exported or used for solicitation.

Intellectual Property

All content on the Site — including text, photographs, graphics, logos, and the Bay Hill Estates name and branding — is the property of Bay Hill Estates Property Owners Association or its licensors and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works of any Site content without our prior written consent.

Disclaimer of Warranties

The Site and Resident Portal are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

All images and conceptual renderings on this Site are for illustrative purposes only and are subject to change. Dimensions, features, and specifications are approximate and not guaranteed.

Limitation of Liability

To the fullest extent permitted by applicable law, Bay Hill Estates Property Owners Association shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Site or Resident Portal — even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these terms or your use of the Site shall not exceed the amount, if any, you have paid to us in the preceding twelve months.

Third-Party Links & Services

The Site may contain links to third-party websites or integrate third-party services. We are not responsible for the content, privacy practices, or terms of those sites. Links are provided for convenience only and do not constitute an endorsement.

AI Assistant

The Resident Portal includes an AI-powered assistant that can answer questions about community governing documents. Responses generated by the AI assistant are for informational purposes only and do not constitute legal advice. Always refer to official governing documents for authoritative guidance, or contact the Board of Directors directly.

Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms of Use by reference.

Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Palm Beach County, Florida.

Changes to These Terms

We reserve the right to modify these Terms of Use at any time. Material changes will be communicated to residents via the Resident Portal or community email. The "Last Updated" date at the top reflects the most recent revision. Continued use of the Site after changes are posted constitutes your acceptance of the updated terms.
